Pay Safe – Business Rules
1. User Registration
- All users must register with accurate, verifiable information (name, email, phone number).
- Users must be 18 years or older to use the platform.
- Each user is responsible for securing their account credentials.
2. Transaction Rules
- Transactions must be conducted only through the Pay Safe platform to be eligible for escrow protection.
- Users must agree on terms before initiating the transaction (e.g., amount, delivery period, product/service details).
- Escrow payments must be approved by both parties before funds are released.
- Pay Safe will not release funds until there is:
- Mutual approval, OR
- Verified evidence of completion submitted by one party and reviewed.
3. Escrow Fund Handling
- Funds received via Paystack or Flutterwave are held securely until conditions are met.
- Users cannot cancel or reverse an escrow payment once it is approved and released.
- Users are responsible for reviewing transaction details before approving fund release.
- Disputed transactions will be handled via Pay Safe’s internal resolution process (see Rule 9).
4. Payment Processing
- All payments must be made through Paystack or Flutterwave.
- Pay Safe does not accept direct bank transfers, cash, or offline payments.
- Pay Safe does not store users’ card or bank details.
5. Dispute and Resolution
- Disputes must be raised within 3 days of transaction completion (or delivery).
- Users must provide evidence (messages, receipts, screenshots, etc.) during a dispute.
- Pay Safe may decide disputes based on submitted evidence but is not legally liable for the outcome.
- Pay Safe’s decision in a dispute is final unless otherwise overruled by a court of law.
6. Mistaken Payments and Errors
- Pay Safe is not liable for any payment mistakenly made, approved, or released by the user.
- Users must review all transaction details carefully before approval.
- If a payment is mistakenly released, Pay Safe cannot guarantee recovery of funds.
7. Platform Usage
- The platform must not be used for:
- Illegal or fraudulent activities
- Money laundering or funding criminal operations
- Sale of restricted or prohibited items
- Violation may lead to immediate suspension or permanent ban.
8. Fees and Charges
- Pay Safe charges a service fee on each escrow transaction. This will be disclosed before payment is initiated.
- Users are responsible for any additional payment processing fees imposed by Paystack or Flutterwave.
9. Refunds
- Refunds may be issued only if both parties agree, or if Pay Safe determines that the seller failed to meet the agreed terms.
- Processing time for refunds may vary depending on the payment processor.
- Pay Safe reserves the right to deduct applicable fees from any refund issued.
10. Legal Jurisdiction
- Pay Safe is registered as a sole proprietorship.
- Any legal claim or dispute must be handled under the laws of Ghana
- Users agree to limit legal claims to the business’s operational assets and not the personal assets of the proprietor.
11. Suspension and Termination
- Accounts may be suspended or terminated without notice for:
- Fraudulent behavior
- Abuse of the platform
- Repeated dispute abuse or malicious activity
- Suspended accounts will not be able to initiate or receive funds.
12. Modifications
- Business rules are subject to change without prior notice.
- Users will be notified of major changes via email or dashboard announcement.
- Continued use of Pay Safe after changes implies acceptance of the new rules.
