Welcome to Pay Safe. By accessing or using our website, services, or platform, you agree to be bound by the following Terms and Conditions ("Terms"). If you do not agree, please do not use our services.

1. About Pay Safe

Pay Safe is an escrow platform that holds funds securely between two parties (typically a buyer and seller) until the terms of a transaction are fulfilled. We facilitate secure transactions using third-party payment processors, including Flutterwave.

2. Acceptance of Terms

By creating an account, using our website, or initiating a transaction, you affirm that you:

  • Are at least 18 years of age
  • Have read and agree to be bound by these Terms
  • Have the legal authority to enter into a binding agreement

3. Use of the Platform

Users agree to:

  • Provide accurate and truthful information
  • Use the platform for lawful purposes only
  • Not misuse, hack, or abuse the platform or services
  • Be solely responsible for their actions, decisions, and transactions on the platform

4. Escrow Transactions

When you initiate an escrow transaction on Pay Safe:

  • Funds are held securely until both parties agree the terms have been met
  • Pay Safe will only release funds based on mutual approval by both parties OR proof of fulfillment based on evidence submitted
  • Users must ensure payment details are accurate before approval or confirmation

5. Payment Processing

  • All payments are processed via  Flutterwave
  • Pay Safe does not store or process sensitive card information directly
  • Transaction fees, where applicable, will be disclosed prior to confirmation

6. No Liability for User Errors

IMPORTANT DISCLAIMER:
Pay Safe is not liable for:

  • Any payments mistakenly sent, approved, or authorized by users
  • Funds released by a user in error or without adequate due diligence
  • Disputes arising outside of the escrow process
  • Failure by any party to meet the agreed terms of a transaction

Users bear full responsibility for double-checking all payment and transaction details before approval or confirmation.

7. Limitation of Liability

To the maximum extent permitted by law:

  • Pay Safe and its owner (sole proprietor) shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your use of our services.
  • If liability is imposed, it shall be limited strictly to the amount of fees paid to Pay Safe in connection with the disputed transaction.

8. Indemnification

You agree to indemnify and hold harmless Pay Safe, its owner, affiliates, and staff from and against any claims, disputes, liabilities, damages, losses, and costs (including legal and attorney fees) arising from:

  • Your use of the service
  • Any breach of these Terms
  • Any transaction between you and another party

9. Dispute Resolution

If a dispute arises:

  • Users must first attempt to resolve it via our dispute resolution tools on the platform
  • Pay Safe may, but is not obligated to, mediate disputes
  • If a user proceeds with legal action, it must be under the laws of Ghana and any litigation must be brought in the courts of Ghana.

10. Sole Proprietor Disclaimer

Pay Safe is operated as a sole proprietorship. As such:

  • All business liability is limited to the business, not the personal assets of the proprietor
  • By using this platform, you acknowledge this business structure and agree to limit any legal claims or damages to the assets and operations of the business only

11. Account Suspension or Termination

We reserve the right to suspend or terminate your account without prior notice if you:

  • Violate any of these Terms
  • Use the platform for fraudulent or unlawful purposes
  • Cause harm to other users or to Pay Safe’s reputation

12. Changes to Terms

We may update these Terms from time to time. Continued use of our platform means you accept any updated Terms. You are encouraged to review this page periodically.
